Terms & Conditions

These terms are an agreement between you and Lloyd IT Limited ("we", "us", "our") and govern your use of Taxiway (the "Service"). By creating an account or using the Service you agree to these terms. Please read them carefully. The Service is free to use, and because your applications run on hardware you own, some responsibilities sit with you rather than with us.

1. The Service

Taxiway is a control plane for servers you own: push to deploy from GitHub, with logs, metrics, managed databases, TLS certificates and backups. Your applications, databases and data run on your own infrastructure, not ours. We provide the Service on the terms set out here, and we may add, change or remove features over time to improve it.

2. Eligibility and your account

You must be at least 18 and able to enter into a contract. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity that happens under your account. Tell us promptly at support@taxiway.cloud if you suspect any unauthorised use.

3. Beta service

The Service is currently offered in beta. This means it may change, and features may occasionally be incomplete or unavailable. We provide the beta on a reasonable-efforts basis and appreciate your patience and feedback as we improve it.

4. The Service is free

Taxiway is provided free of charge. There is no subscription, no card required, no trial period, and no feature held back behind a payment. You pay only for your own server, domain and any storage you choose to use, and you pay those providers directly rather than us.

• We may introduce paid plans in future. If we do, they will be for additional capabilities. Features that are free as at the date of these terms will remain free.
• We will give you at least 30 days' notice of any change to these terms that affects what is included at no cost.
• You may choose to support the project financially. Any such contribution is entirely voluntary, is non-refundable, and grants no additional features, priority, service level or other contractual right.

5. Your server and your responsibilities

The Service runs your workloads on infrastructure you provide and control. That is the point of it, and it means the following are yours rather than ours:

• The server itself. You obtain it, pay for it, and remain bound by your hosting provider's terms. We do not supply hosting.
• Host security and maintenance. Operating system updates, firewall rules, physical and network security, and capacity are your responsibility.
• Agent privileges. Our agent requires access to the Docker socket on your server in order to work. That access is root-equivalent on that machine. By installing the agent you accept that this is necessary and appropriate for your environment.
• Verifying your backups. We provide backup tooling and write to storage you nominate. Checking that your backups exist and restore correctly remains your responsibility.

6. Closing your account

You can stop using the Service and close your account at any time, at no cost and without giving a reason. Because the Service is free there is nothing to cancel and nothing to refund.

Your servers and data remain yours. Containers we deployed keep running, your databases and volumes are untouched, and any backups already written to your own storage stay where they are. What stops is the Service itself: the dashboard, new deployments, log and metric collection, and the renewal of TLS certificates we issue on your behalf. Certificates already issued continue to work until they expire, so you should plan any migration within that window.

7. Acceptable use

You agree not to use the Service to:

• break the law or infringe anyone's rights;
• host or distribute malware, or attack or disrupt others' systems;
• send spam or unlawful, abusive or infringing content;
• attempt to gain unauthorised access to, or disrupt, the Service or its infrastructure; or
• resell or misrepresent the Service.

We may suspend or terminate accounts that breach this section, especially where there is a risk to others or to the Service.

8. Your content and data

You retain all ownership of your applications, code and data. You grant us the limited permissions we need to operate the Service for you: to build, deploy, run and monitor your services. You are responsible for your content, for having the rights to use it, and for backing up anything important. How we handle data is set out in our Privacy Policy and Data Policy.

9. Intellectual property

The Service, including its software, branding and design, belongs to us and our licensors. These terms don't transfer any of our intellectual property to you beyond the right to use the Service as intended.

10. Third-party services

The Service connects to third parties such as GitHub, your hosting and object storage providers, and the certificate authority that issues your TLS certificates. Your use of those services is governed by their own terms, and we are not responsible for them.

11. Availability

We work hard to keep the Service available but do not guarantee it will be uninterrupted or error-free, particularly during beta, and the Service is provided free of charge without any service level commitment. We may carry out maintenance, and may modify or discontinue parts of the Service, giving notice where reasonable. If our control plane is unavailable, applications already deployed to your servers continue to run and to serve traffic; what you lose is the ability to make changes.

12. Warranties and liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under law.

Subject to that, we are not liable for loss of profits, revenue, data or business, or for indirect or consequential loss; and our total liability to you in any 12-month period is limited to £100. The Service is supplied free of charge, and that limit reflects it. You are responsible for backing up your own data and for testing that those backups restore.

13. Indemnity

You agree to indemnify us against claims, losses and costs arising from your breach of these terms or your misuse of the Service.

14. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends, but any terms which by their nature should survive (such as liability, indemnity and intellectual property) will continue.

15. Changes to these terms

We may update these terms from time to time. When we make material changes we will update the "last updated" date above and notify you where appropriate. Continuing to use the Service after changes take effect means you accept the updated terms.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may benefit from any mandatory protections of the country where you live.
